1. Acceptance of Terms

By using the services ("Services") provided by Mognova Inc. DBA Mognova Safety ("Company", "we", "our", "us"), you agree to these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.

To the maximum extent permitted by law, Mognova Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Services; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the Services; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Services by any third party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the Services; and/or (vi) the defamatory, offensive, or illegal conduct of any third party.

You agree to indemnify, defend, and hold harmless Mognova Inc. and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Services, or your violation of these Terms.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state of Minnesota, without regard to its conflict of law principles.

8. Changes to Terms

We may modify these Terms at any time. We will notify you of any changes by posting the new Terms on our website and updating the effective date. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.
